- The Republic of South Sudan has received financing from the International Development Association (IDA) towards the cost of the South Sudan Private Sector Development Project (PSDP), and intends to apply part of the proceeds for the paymentof this Individual consultant (IC) services.
- The project supports; (a) Establishment of commercially -Viable Microfinance Institutions; (b) Promotion of Micro-Entrepreneurship by catalyzing entrepreneurship through a Business Plan Competition (BPC) forexisting businesses and start-ups; (c) Mobile Payments and Trade Integration Policy, and (d) Institutional Strengthening of the South SudanBusiness Forum and Project Management.
- The duties/scope of the consultant will include the following;
The consultant will work with the technicalteam under the Directorate of Bank Supervision, Research and Statistics at the BSS and in close consultation with other key stakeholders such as MoFCIEP, Ministry of Telecommunications and Postal Services (MoTPS), Commercial Banks,non-bank mobile operators and relevant private sector players in ICT.Specially, the consultant will carry out the following tasks;
i. Examine the financial sector setting in South Sudan including any other relevant studies on financial sector performance and conditions.
ii. Project cycle Management, Review existing legal and regulatory framework (such as Banking Act, various prudential directives and regulations) in order to obtain a full understanding of the legal basis for the provision of payment services, mobile financial services, and issuance of electronic money (e-money);
iii. Identify any opportunities, shortcomings and elements of mobile banking services that must be addressed so as to support the goals and objectivesof developing the regulatory framework for e-banking and payments that will enhance financial access in South Sudan and maximize the benefits for all potential users;
iv. Withinthe context of national and regional developments on retail financialservices, mobile financial services and electronic money issuance, identify and articulate key regulatory concerns or constraints that should be addressed while developing the legal and regulatory framework and providing recommendation;
v. Undertake a mapping and identification of stakeholders to ensure that stakeholder engagement is infused into the project throughoutits lifecycle (i.e. as an iterative process).
vi. Following on from the above, facilitate establishment of a Joint Mobile Banking Coordinating Group (JMBCG) comprising of members from the South Sudan Bankers' Association, mobile operators, relevant institutions and government ministries to carryout a consultative process on the proposed regulatory framework;
vii. Conduct interviews with key stakeholders (including the BSS, Government departments, Commercial Banks, Telecommunication companies and other non-bank paymentoperators) via a variety of forms such as - face-to-face interviews, video conferencing, round-table discussions as well as via structured questionnaires in order to understand the market size and potential for growth of the mobile financial services in South Sudan.
viii. Develop an Action Plan including activities and responsibilities areas with suggestions on the appropriate legal and regulatory framework to be considered;
ix. Prepare an interim report and Final report to be presented in person to the BSS and other stakeholders such as the JMBCG at a workshop to be organised by the Central BSS.

- The consultancy is expected to cover a maximum of 45 working days, commencing in November 2013.
- SelectionCriteria: The selection shall be conducted based on qualification and experience of the candidates list below;
i. A mobile banking or financial services regulatory expert, with extensive familiarity with financial sector laws and regulations in a developing economy context.
ii. A holder of a recognized university degree in Law or Economics or Financial Management and a related post graduate degree in one of these fields, preferably a master's degree or professional qualification in Finance or Economics or Law.
iii. With more than ten (10) years' working experience on similar economic environments as South Sudan.

- A Consultant will be selected in accordance with the procedures set out in the World Bank's Guidelines: Selection and Employment of Consultants under IBRD Loans and IDA Credits & Grants by World Bank Borrowers dated January 2011.
