Consultancy to Develop Communication and Engagement Strategy for DPA

Responsibilities: The consulting The Consultant will work under the guidance of the DPA’s Director-General and in close coordination with its Marketing, Communication, and Engagement Consultant. The assignment will be structured around the following key components: Rapid Landscape and Gap Assessment, Development of the Communication and Engagement Strategy, Media, Advertising, Outreach Costs, and Translation Services and Institutional Capacity Building. Duration: The firm is expected to complete the proposed assignment within 4 months. 4. The shortlisting criteria are as follows: • Core business of the firm; Minimum of 5 years of experience with expertise in the communication and public relations field. Proven experience in developing communication and engagement strategies, preferably in regulatory or public sector institutions within fragile or developing country contexts. Experience in stakeholder engagement and public awareness campaigns in Somalia. • The Consultant shall provide the name and contact address of the Client (office and e-mail address and telephone number), date(s) of execution, name (s) of lead and associate firms, contract amount and financing sources. • Experience of relevant services in an environment similar to that of Somalia and • Technical and managerial organization of the firm (provide only the structure of the organization). Background: The Federal Government of Somalia, through the National Communications Authority (NCA) and the Ministry of Communications and Technology (MoCT), is working to strengthen national cybersecurity to protect its digital infrastructure. Cybersecurity is seen as essential to building trust in the digital economy. The NCA, established under the 2017 Communications Act, regulates Somalia's communications sector and leads the national cybersecurity response. The Republic of Somalia has received financing from the World Bank towards the cost of the Somalia Capacity Advancement, Livelihood and Entrepreneurship, through Digital Uplift Program (SCALED-UP) project; and intends to apply part of the proceeds of the above project to finance the Consultancy Services for Cybersecurity Risk and Compliance Framework Development under National Communications Authority (NCA) 2. Responsibilities: The consulting firm will be responsible for carrying out several key tasks aimed at strengthening Somalia’s national cybersecurity framework. First, it will identify and classify critical infrastructure (CI) and critical information infrastructure (CII) assets, as well as relevant stakeholders, and conduct a comprehensive national cybersecurity risk assessment. Based on this assessment, the firm will develop a National Cybersecurity Risk Management Framework specifically tailored to Somalia’s unique context and needs. Additionally, the firm will establish compliance standards for both the public and private sectors, ensuring that these standards align with existing national laws and international best practices. Finally, the firm will support the implementation of these frameworks by enhancing awareness and building capacity among key stakeholders. Background: The Federal Government of Somalia has recently enacted the Somali Data Protection Law (DPL) 2023, mandating the establishment of the Somali Data Protection Authority (DPA). The DPA will serve as the primary federal institution responsible for the implementation, enforcement, and oversight of the DPL, ensuring compliance and developing national regulations on data protection and privacy. The DPA is currently a key beneficiary of a World Bank-financed investment operation, the Somalia Capacity Advancement, Livelihoods and Entrepreneurship through Digital Uplift Project (SCALED-UP). The Project, inter alia, seeks to strengthen FGS’s capacity to support wider access to digitally enabled services and ensure that the enabling legal frameworks are in place to support said scale up in digital services. DPA intends to use part of the proceeds to hire an Embedded Legal Advisor (Individual Consultant). 2. Responsibilities: The role encompasses Legal Advisory, Policy and Framework Development, Capacity Building, Stakeholder Engagement, and Monitoring and Compliance; Under Legal Advisory, the individual will be responsible for drafting, reviewing, and updating data protection regulations and policies to align with international best practices. This includes identifying key legal gaps, recommending improvements, and providing legal opinions on issues such as data privacy, cybersecurity, and AI governance; The role also requires ensuring that all internal rules, procedures, and regulations are consistent with Somalia’s Data Protection Act and related legislation; In the area of Policy and Framework Development, the focus is on creating and implementing legal structures to enhance data protection and cybersecurity. This includes drafting ethical and legal guidelines for the use of Artificial Intelligence and working collaboratively with various stakeholders to address emerging data governance challenges; Capacity Building involves organizing and leading training sessions on data protection laws and international best practices for both staff and stakeholders. It also includes developing tools, resources, internal notes, and presentation materials to raise awareness about cybersecurity and AI-related risks.The Consultant will be based in Mogadishu, Somalia. The Legal Advisor should possess a combination of relevant education, experience, and skills. The following qualifications are required: • Bachelor’s degree in Law (LLB) is mandatory and Master’s degree in Law, Cybersecurity, or related fields is a must. • Minimum of 10 years of experience in legal data protection and privacy, advisory roles, including with a strong track record of providing legal and policy formulation advisory support to governments and governance. • Proven expertise in data protection, cybersecurity laws, and legal aspects of Artificial Intelligence. • Experience working with government agencies, international organizations, or private entities on data governance. • Demonstrated experience in supporting organizational development in public sector settings with strong understanding of and experience in building institutional capacities related to data governance. • Privacy certifications from recognized international organizations are a plus. • In-depth knowledge of international and regional data protection laws (e.g., GDPR, AU Convention on Cybersecurity). Based on these findings, the firm will develop clear and consistent SOPs to enhance operational clarity across NIRA’s core management teams, departments, units, sections, and cross-cutting activities. The firm will train NIRA staff on the new SOPs, their implementation, and future updates. The firm will also analyze NIRA’s existing institutional structure, ensuring alignment with its mandate and objectives. It will also develop a Service Charter that defines NIRA’s commitment to service delivery and outlines expected service standards and design a Monitoring, Evaluation, Accountability, and Learning (MEAL) framework aligned with NIRA’s strategic objectives to support continuous improvement and effectiveness. Background: The Federal Government of Somalia has recently passed a new data protection law - the Somali Data Protection Law (DPL) 2023 - that requires the establishment of Somali Data Protection Authority (DPA) to oversee the implementation of the law. The Authority will be the lead Federal Government body mandated to implement and enforce compliance of the DPL and formulate national regulations related to data protection and privacy. The DPA is currently a key beneficiary of a World Bank-financed investment operation, the Somalia Capacity Advancement, Livelihoods and Entrepreneurship through Digital Uplift Project (SCALED-UP). The Project seeks to strengthen FGS’s capacity to support wider access of digital-enabled services, where ensuring that enabling legal framework is in place to support SCALED UP in digital services is seen as critical. The Project will among others seek to strengthen the Government’s capacity to manage data protection. It will help lay the foundations for safeguarding data protection in compliance with the recently passed DPL. The Data Protection Authority intends to apply part of the proceeds of the above project to finance the position of the Embedded Advisor for Project Management (Individual Consultant). 2. Responsibilities: In supporting the DPA, the Consultant will carry out several duties, including assisting the DPA Director General in managing the overall implementation of the broader project to operationalize the DPA, developing and implementing a detailed project work plan, monitoring and evaluating project activities, and preparing progress reports. The Consultant will oversee the procurement of goods and services required for establishing the new DPA, including developing procurement plans, preparing bidding documents, and selecting suppliers. Additionally, they will contribute to the development and implementation of a 5-year strategic plan (to be developed by a consulting firm). The Consultant will liaise with the World Bank and PIU to update and monitor the annual work plan, ensuring all project activities are implemented in accordance with the plan, that project outputs and outcomes are achieved within the specified timeframe and budget, and that any issues are addressed promptly. SCALED-UP’s development objective is “increase access to more affordable internet, crowd-in private investment in the ICT sector, and improve the government’s capacity to deliver digital government services in Somalia, by contributing to the development of a regionally integrated digital infrastructure and enabling environment 2. Responsibilities: The Technical Advisor is responsible for supporting the Ministry of Communications and Technology (MoCT) and the Project Implementation Unit (PIU) in key areas related to the National Data Centre; The advisor will work closely with MoCT to develop a business model for managing and expanding National Data Centre assets and their role within the Somalia Government; Additionally, He/ She will create a concise roadmap for Data Center facilities, ensuring that all dependencies are delivered on time and meet operational requirements. Responsibilities: The Macroeconomic Expert is tasked with supporting the Central Bank of Somalia (CBS) and its Research and Statistics Department (RSD) to enhance staff capacity in producing high-quality economic reports, conducting research, performing policy analysis, and undertaking economic modelling. The primary goal is to provide accurate medium- and long-term growth forecasts for the country using reliable macroeconomic data. This effort aligns with Article 5(a) of the Central Bank of Somalia Act, which mandates the CBS to formulate and implement monetary and exchange rate policies. The department seeks to ensure that policymaking is grounded in strong conceptual and empirical foundations, translating technical analysis into policy-relevant communication that is accessible to both policymakers and the general public. To achieve this, the Macroeconomic Expert will review the current practices in economic and policy analysis within the RSD and establish a comprehensive macroeconomic model to support forecasting activities. This includes building projection capabilities in key areas such as the Real Sector (inflation and GDP), External Sector (balance of payments and public debt), Government Fiscal Operations (revenue and expenditure forecasting), and the Financial Sector (asset growth projections and liquidity).
