1. Acceptance of Terms
Bidanga (bidanga.com) is operated by ABNA, a company established in Canada (“Bidanga”, “we”, “us”). By accessing and using Bidanga, you accept and agree to be bound by these Terms of Service. In addition, when using particular services of the platform, you shall be subject to any posted guidelines or rules applicable to such services.
2. Description of Service
Bidanga provides a pan-African public procurement intelligence platform that aggregates, indexes, and presents public tender information from government entities and official publications across 54 African countries. The service is provided in accordance with the Open Contracting Data Standard (OCDS 1.1.5). Bidanga is an independent aggregator: it is not a government body, does not publish official notices, and is not affiliated with the contracting authorities whose tenders it references.
3. User Accounts
To access certain features of the platform, you must register for an account, either with an email address and password or through Google Sign-In. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Plans and Fees
Core access to Bidanga is currently free of charge. Premium and Enterprise plans are described on our pricing page; where and when paid subscriptions are made available for purchase, the applicable price, billing period, payment provider, and cancellation terms will be displayed before you subscribe and will form part of these Terms.
5. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any part of the platform
- Scrape, crawl, or systematically download data without prior written authorization
- Use the API beyond documented rate limits or resell API access without authorization
- Interfere with or disrupt the integrity or performance of the service
- Transmit any harmful, offensive, or disruptive content
6. Intellectual Property
The Bidanga platform, including its design, software, and content (excluding public procurement data which is subject to open data licenses), is the property of ABNA and is protected by applicable intellectual property laws. Public procurement data is sourced from government entities and official publications and remains subject to their respective open data policies.
7. Privacy
Your use of Bidanga is also governed by our Privacy Policy, which is incorporated by reference into these Terms of Service.
8. Disclaimer of Warranties
The service is provided on an “as is” and “as available” basis. Bidanga makes no warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the procurement data will be complete, accurate, or up-to-date at all times. Tender information presented on Bidanga is provided for information purposes only: before submitting a bid, always verify deadlines, requirements, and documents against the official notice published by the contracting authority.
9. Limitation of Liability
In no event shall Bidanga or ABNA be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the service — including any decision made or bid submitted in reliance on information found on the platform — even if Bidanga has been advised of the possibility of such damages.
10. Governing Law
These Terms are governed by the laws of Canada. Any dispute arising out of or relating to these Terms or the service shall be submitted to the competent courts of Canada, unless mandatory consumer-protection rules of your country of residence provide otherwise.
11. Changes to Terms
Bidanga reserves the right to modify these terms at any time. We will provide notice of significant changes by posting the new Terms of Service on this page and updating the “Last updated” date. Your continued use of the service after any changes constitutes your acceptance of the new Terms.
