As part of this initiative, a consultancy is required to undertake a gap analysis of the current ICT security of law enforcement agencies and criminal justice bodies, legal and regulatory frameworks, and develop requisite instruments, including a comprehensive Cybersecurity Bill to address identified gaps. The initiative is in line with the National Cybersecurity Policy, Strategy and Action Plan 2022-2026. Specifically, under Section 4.3, Pillar 3 of the Policy focuses on reinforcing the legal and regulatory framework for cybersecurity. As stipulated in the policy document, the objective of Pillar 3 is “To strengthen the existing legal and regulatory framework to adequately address cybercrime and facilitate the criminalization of acts related to cyber-crimes that are not addressed by existing law, yet pose a potent threat to national security” Based on the aforementioned realities, the Ministry of Communications and Digital Economy through WARDIP PIU, is hereby recruiting an individual Consultant to conduct a Gap Analysis of ICT Security of law enforcement agencies and criminal justice bodies and develop requisite Instruments, Legal Framework, and a Cybersecurity Bill. Objectives of the Assignment The consultancy aims to: • Undertake a comprehensive gap analysis of the current ICT security of law enforcement agencies and criminal justice bodies, legal, and regulatory frameworks such as the IC Act 2009, National cybersecurity policy 2022-2026, among others. • Develop requisite instruments to address identified gaps, including preventive, substantive, procedural, privacy, and data protection issues. • Draft a Cybersecurity Bill that aligns with international standards (such as the AU Convention on Cybersecurity and Personal Data Protection, ECOWAS Directives on Cybersecurity, among others) and caters to the specific needs and context of The Gambia. Consultant Qualifications: The consultant should possess the following qualifications, experience, and skills tailored to the assignment: • Must possess advanced academic qualifications (Master’s or higher) in Cybersecurity, ICT Law, or related fields. • Must possess proof of documentation/qualification/certification of strong understanding of international cybercrime frameworks, trends, and strategies for digital crime mitigation. • Minimum of 7 years of professional experience in ICT security, cybercrime legislation, and cybersecurity framework development. • Proven track record of at least 10 years in ICT security consultancy, cybercrime policy, and legal framework development. • 5 years demonstrated experience in conducting gap analyses and drafting ICT-related policies, frameworks, and legislation/Bills in line with international standards. • Prior engagement in similar assignments, preferably within developing countries or regions with comparable contexts is a Must. • Must have 3 years familiarity with The Gambia’s legal system and/or international standards for cybercrime prevention, such as the AU Malabo Convention Cybersecurity and Personal Data Protection, UN Cybercrime Convention, the ECOWAS Directive on the Fight against Cybercrime and other relevant conventions. Affordable, reliable, and resilient international connectivity is critical to The Gambia’s digital transformation and economic growth. The country is currently connected to the Africa Coast to Europe (ACE) submarine cable system through the Gambia Submarine Cable Company (GSC), a public–private Special Purpose Vehicle (SPV). To enhance redundancy and resilience, the Government is advancing the deployment of a second submarine cable under WARDIP. Rather than establishing a new entity, the Government has agreed in principle to evolve GSC into a commercially sustainable, multi-cable SPV (“GSC 2.0”) capable of managing both: • The existing ACE system; and • The second WARDIP-supported submarine cable. The assignment is therefore aimed at structuring a bankable, commercially driven transaction where private capital plays a leading role and public financing is used only on a catalytic or residual basis. Objectives of the Assignment The objective of the assignment is to evolve and operationalize GSC into a financially viable, commercially sustainable, and well-governed multi-cable SPV (GSC 2.0), capable of owning, operating, and commercializing both cable systems . Scope of Work The Consultant shall provide integrated legal, financial, commercial, and transaction advisory services covering: • Legal, regulatory, and institutional assessment of GSC; • Design of alternative corporate and capital structures (including ring-fenced options); • Development of financial models (IRR, NPV, DSCR and sensitivity analysis); • Drafting of governance documents and shareholders’ agreements; • Advisory support for investor engagement and financial close; • Preparation of an implementation roadmap. The primary goal of DTfA/WARDIP-SOP1 is to expand broadband access and usage while strengthening the foundation for Digital Financial Services (DFS) and selected digital public services, ultimately advancing the creation of a Single Digital Market in Western Africa. This initiative will accelerate the achievement of national digital development objectives, while also aligning with regional digital transformation goals. The Gambia currently relies on a single submarine cable for connectivity, ACE Cable which will meet its end of life soon. To meet the country’s increasing digital needs, the arrival of a second submarine cable is a critical step. This new infrastructure will not only support the rapid expansion of digital services nationwide but will also provide redundancy for the existing cable, enhance overall connectivity, and improve service quality and cost for the public, businesses, and e-governance services. In view of the above, DTfA/WARDIP, through the Ministry of Communications and Digital Economy (MOCDE), is seeking to engage a qualified firm to conduct an ESIA study for the deployment of a second submarine cable, construction of a beach manhole & cable landing station. Objectives of the Assignment The objective of this consultancy is to develop a comprehensive Environmental and Social Impact Assessment that aligns with the national environmental and social laws and guidelines: NEMA 1994, EIA Regulations 2014 (revised ESIA regulations 2025), EIA Guidelines 1999 (ESIA Guidelines 2025), Labor Act 2024, EIA procedures and related instruments) and the WB ESSs. The Assessment will focus on: Scope of Work The Terms of Reference have been developed to recruit a qualified firm to conduct an Environmental and Social Impact Assessment (ESIA) for both the Marine & Coastal Segment (MCS) and the Terrestrial Segment (TS). The MCS involves designing and laying the cable from deep sea to the shore, while the TS includes the construction of a Beach Manhole (BMH) and Cable Landing Station (CLS), as well as the operation and maintenance of the cable. Additionally, the TS encompasses the creation of an access road from the CLS to the BMH and the connection of the cable from the BMH to the CLS building. Firm Qualifications The firm selected must have the following qualifications: Experience of the firm: • The firm should demonstrate a proven track record of successfully completing at least five (5) ESIA assignments, • demonstrate that they have professional skills and proven experience in carrying out similar projects over the past ten (10) years, • Provide administrative documents proving the legal existence of the firm and its organization (administrative or technical staff of the firm/group, organizational capacity, etc.), • Demonstrated understanding and experience in working with government agencies, multilateral and bilateral organizations on developmental issues in developing countries, A successful firm must partner with a local firm. Proposed Team Composition Team Leader: An MSc in Project Management, Development Studies Economics, Environmental Management/Planning, Natural Resources Management or related fields with at least 10 years of professional work experience leading ESIAs studies for similar projects. Environmental Expert: An MSc in Environmental Engineering or related field with at least 8 years of professional work experience in conducting at least 3 assignments in developing ESIA/ESMP for civil works or similar projects. Socioeconomic Expert: An MA in Economics, development studies, statistics, or related discipline with at least 5 years of professional work experience in socio-economic studies, particularly in West African countries. Gender/GBV Expert: An MA in Gender and Development, Development Studies, Sociology, or a related social science discipline with at least five (5) years of progressive professional experience in gender and social development is required. Fiber Optic/Submarine Expert: An MSc in Telecommunications or a related field with proven experience and understanding of fiber-optic or submarine cable systems and have technical knowledge of submarine cable technology, network planning, design and deployment. Recognizing this, the Government of The Gambia, through its National Cybersecurity Strategy (2022–2026), has committed to enhancing the operationalization of the Digital Forensics Lab (DFL) a critical entity to support national cybercrime response efforts. While the DFL is envisaged as a modern facility for processing and storing and investigating digital evidence, its effectiveness relies not only on physical infrastructure and technical tools, but on a functional institutional framework that enables its full operationalisation. As outlined in The National Cybersecurity Policy 2022-2026 under Action Point 7.6.3.1.1.5 (Page 26), one of the key strategic actions is to “establish the requisite framework to operationalize a digital forensics laboratory.” This entails developing clear institutional mandates, governance structures, inter-agency coordination mechanisms, standard operating procedures, and legal and regulatory alignment to ensure that the DFL can function efficiently and with credibility. Furthermore, it must ensure role clarity among stakeholders such as law enforcement, intelligence agencies, the judiciary, regulatory bodies, etc. This consultancy is therefore initiated to design a comprehensive institutional framework that will underpin the full operationalization of the DFL. The framework will define the roles, responsibilities, policies, protocols, and coordination mechanisms required for the lab to operate effectively and sustainably in support of national cybersecurity and digital justice efforts. Objectives of the assignment: OBJECTIVES OF THE ASSIGNMENT The main objective of this consultancy is to design, develop and deliver a clear, practical institutional framework to operationalize the National Computer Forensics Laboratory (NCFL) in The Gambia. Specific objectives include: • Assess current institutional arrangements, governance gaps, and stakeholder needs related to digital forensics and other documents, such as MoUs, SOPs, etc. • Define a governance and management structure for the DFL, including leadership bodies, reporting lines and decision-making authorities. • Clarify roles and responsibilities of all stakeholders (law enforcement, judiciary, intelligence services, regulators and DFL staff) in the digital forensics process. • Develop a draft standard operating procedures (SOPs) for evidence collection, analysis, storage, chain of custody, disposal, etc. • Review existing legal and regulatory frameworks; recommend amendments or new provisions to enable NCFL operations. • Design inter-agency coordination mechanisms, including communication channels, referral protocols and joint working groups. The Firm should have: • A minimum 10 years of operational experience delivering consultancy services in cybersecurity and digital forensics • Proven track record in successfully executing at least three(3) similar institutional frameworks or digital forensics projects, preferably for law enforcement, government, or international organisations. • Must have a strong background in Project Management with at least 3 years of managing similar projects. • Experience working in the African region or in developing country contexts will be an added advantage. • Availability of a multidisciplinary team with expertise in cybersecurity, digital forensics, legal and regulatory affairs, and project management. • Experience in Digital Forensics Tools like Cellebrite UFED,Cellebrite Physical Analyzer, XRY Software,BlockBox Lab XL (RF Forensic box), X-Ways Forensic etc. would be an added advantage. Addressing these gaps through improvement and the development of new digital public services is essential to enhancing service delivery, ensuring equitable access, and fostering economic growth. Given the above, GICTA through the DTfA/WARDIP seeks to hire a consultant to review existing digital public services comprehensively. This consultancy aims to identify service gaps, areas for improvement, and strategies for enhancing the overall quality and accessibility of government digital services. Objectives The primary objective is to conduct a Digital Public Services Gaps Analysis with the following objectives: • Conduct a thorough analysis of existing digital public services offered by the government. • Identify gaps and deficiencies in the current digital public services offerings. • Develop recommendations and strategies for improving the quality, efficiency, and accessibility of existing digital public services. • Recommend new digital services for implementation to bridge the gaps identified in the services. • Produce a comprehensive report that includes the findings and recommendations. Scope of Work Service Gap analysis: Assessment of existing e-services: • The objective of this assessment, and the satisfaction of users and identify recommendations and action plan for their improvement. • Evaluate the accessibility, and usability of the current e-services, and identify areas for improvement within current digital public services; enhance operations and the user experience to better serve the public, support economic development and ensure sustainable digital governance. From the demand side: • conduct a user journey mapping for the users accessing the digital services, identify pain points, and access issues for different types of users (by gender, age category, and disability status), as well as user satisfaction with the e-services. From the supply side: • Identify all current digital services provided by Ministries, Departments and Agencies (MDAs) and document the processes, functionalities and purposes of each service (a non-exhaustive list of potential MDAs is included in the annex). E-Government development analysis: roadmap for adding future digital services The objective of this assessment is to identify all services that are delivered by government entities (Government-to-Government (G2G), Government-to-Business (G2B), and Citizen (G2C)), assess their potential for digitalization and establish a prioritization of services based on a set of criteria to be identified and developed. • Conduct an exercise to identify all services delivered by Ministries, Departments and Agencies, and to document the processes, functionalities, and purposes of each service. • Identification and development of evaluation criteria which may include the volume/numbers of users of services, readiness for and feasibility of digitalization, potential impact of digitalization in reduction of cost/time for users etc. Assessment of government capacity to deliver digital services: Infrastructure, Governance and capabilities. Infrastructure and interoperability The objective of this section is to assess infrastructure and technology supporting the delivery and scaling-up of e-services and provide recommendations for improvement. • Assess infrastructure needs toward a unified/consolidated digital service offering. • Assess data hosting needs. Governance, processes and capabilities: The objective of this section is to assess the institutional capacity gap to deliver and scale up services and provide recommendations for development to support the improvement of existing services (from the gap analysis) and integration of future services (from the e-government development analysis). • Assess institutional capabilities toward a unified approach to e-services (coordination, digital governance arrangements) • Skills and HR needs for IT management and use (digital skills, infrastructure, data hosting, development etc.) Key Deliverables The project implementation period will be 6 months from the date of the contract signature. The overall aim of the proposed WARDIP-SOP1 is to increase access to and usage of broadband and to strengthen the foundations for digital financial services (DFS) and selected digital public services towards a single digital market in Western Africa. This project will ensure that national digital development objectives are met more effectively and rapidly while also taking regional digital transformation objectives into account. National policies, regulations and implementation of strategic programs would need to be improved further while addressing barriers to cross-border connectivity, data flows and digital services for a seamless and competitive national and regional digital ecosystem to emerge. This would result in a self-perpetuating cycle of economic growth, investment, innovation, job creation and improved service delivery at the national and regional levels. To achieve this objective, the project will consist of three interlinked technical components, in addition to the Project Implementation and Coordination Component, and a Contingent Emergency Response Component (CERC) to address the key binding constraints for the development and attainment of a digital economy. In view of this, the Government of The Gambia, through the Ministry of Communications and Digital Economy (MoCDE), established a Project Implementation Unit (PIU) as a starting point to kick start the activities entailed in this fund and, as thus, seeks to recruit a consulting firm for the Identification and strengthening of cybersecurity management and Critical Information Infrastructure of The Gambia: SCOPE OF WORK The Consultancy is, within twelve (12) months from the start of the exercise, to: • Establish a holistic and comprehensive cybersecurity management framework tailored to The Gambia's context, that improves the Cybersecurity Posture of the Country. • Identify and designate ICT driven sectors and entities that are extremely essential to the socio-economic development as Critical Information Infrastructure (CII), • Enhance the resilience of critical sectors against cyber threats.
