The Judiciary of Zanzibar has received financing from the World Bank toward the cost of the Judicial Modernization Project (Zi-JUMP) and intends to apply part of the proceeds for Consultancy Services.
The consulting services (“the Services”) include in access to justice services the project focuses aims to enhance the accessibility of judicial services by ensuring that justice is within the reach of all citizens of Zanzibar, implementation period is 32 weeks, expected start month of assignment is December 2024.
The Judiciary of Zanzibar now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.
The short-listing criteria are:
- Core Business of the firm and Seven (7) years in business.
- Relevant similar experience, which should specifically include the following;
i. Experience of at least three (3) similar gender justice strategy assignments in the past five (5) years cumulative years - Information to be provided should include name of assignments, names and full contact addresses of the Clients, contract value (in equivalent US dollars) and period (dates) of execution of assignments.
ii. Demonstration of experience of work in similar conditions.
c. Technical and Managerial Capability of the firm (the Consultant must provide the general qualifications, number of Key staffs and structure of the organization).
(Do not provide CV of the Key staff. Key Experts will not be evaluated at the shortlisting stage).
The attention of interested Consultants is drawn to Section III, paragraph, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers “fifth edition September 2023 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.
Consultants may associate with other firms in the form of a joint venture or a sub consultancy to enhance their qualifications. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected. For firms participating in a JV, each member of the JV should independently meet the requirement of EoI criteria. For firms participating as association of lead and sub consultant, only the experience and qualification of lead firm will be assessed as per EoI criteria
A Consultant will be selected in accordance with the Consultant’s Qualifications Based Selection (CQS) set out in the World Bank Procurement Regulations for IPF Borrowers Fifth Edition, dated September 2023;

FOR CONSULTANCY SERVICE TO DEVELOP GENDER JUSTICE STRATEGY UNDER THE JUDICIARY MODERNIZATION PROJECT (Zi JUMP)

- INTRODUCTION
- The Judiciary of Zanzibar (JoZ) is embarking on a collaborative Project by the name of The Zanzibar Judiciary Modernization Project (Zi-JUMP), whereby the World Bank (WB) stands to be the cooperative Development Partner in financially supporting the project's implementation. In enhancing the accessibility, efficiency, and transparency of selected citizen-centric judicial services in Zanzibar, the Zi-JUMP is structured around three core components, namely:
- Access to Justice Services: This aims to enhance the accessibility of judicial services by ensuring that justice is within the reach of all citizens of Zanzibar. It focuses on expanding and improving the physical and digital infrastructure to make them more accessible, secure, and user-friendly, by constructing new court buildings, and refurbishing the existing ones, with a special emphasis on marginalized and vulnerable groups. Additionally, in resolving disputes more quickly and amicably, the Court-annexed Alternative Dispute Resolution (ADR) mechanism will be strengthened; knowledge exchange around ADR will be conducted and women will be trained to become mediators and address the stark gender imbalance in dispute resolution due to the all-male kadhi environment. Finally, JoZ will develop its first gender justice strategy to address gender disparities within the judicial system and ensure that women and men have equal access to justice. The strategy will integrate gender consideration into all aspects of the judicial modernization process, fostering a more inclusive and equitable judicial system.
- Court Efficiency: This aims to enhance court efficiency by improving the operational effectiveness of the judicial system to expedite processes and reduce case backlogs. This will involve training judicial and non-judicial staff in decision-making, implementing electronic services, and updating procedural rules. Additionally, a comprehensive Judicial Information Management System (JIMS) will be established (e-case management and e-analytical) to ensure accurate data management. At the same time, a Performance Management System (PMS) will be developed to support ongoing monitoring and evaluate the performance of courts and judicial officers.
- Citizen and stakeholder engagement: This aims to enhance citizen and stakeholder engagement with the judiciary by promoting transparency and improving communication through public awareness campaigns, various media outlets, and the annual Zanzibar Law Week.[1] It will involve the development of interventions to engage key stakeholders and implement initiatives like Court User Satisfaction Surveys to gather feedback on their experience with JoZ and improve judicial services. These surveys will support JoZ in steering its overall reform efforts and feeding findings into the activities after the survey findings have been discussed among relevant stakeholders, and aggregated survey results be published on JoZ’s website.
- BACKGROUND SPECIFIC TO THE ASSIGNMENT
- Gender inequality remains a challenge for the Judiciary of Zanzibar and also women face challenges in accessing justice in Zanzibar. This affects both the internal workings of the judiciary and the external experiences of court users:
- Internal Aspects:
- Gender composition of judicial staff: According to the current data (2024), only 35 percent of judicial staff are female (judges: 5 out of 14; magistrates: 23 out of 66; Kadhis: zero out of 20) while the non-judicial staff is nearly balanced at 50.8 percent (females: 189 out of 372).
- Hiring, retention, and promotion practices: There is a significant gender imbalance in hiring, retention, and promotion practices, with fewer women in senior judicial positions such as judges and magistrates. According to the JoZ needs assessment and confirmed during project preparation, there is a gender imbalance in judges' and magistrates' staffing and in how (potential) court users are approached. Only 35 percent of judges and magistrates are female and women who access court services often lack awareness of how needs vary across different court users. The lack of a comprehensive gender strategy means that there are no targeted efforts to attract women into the judiciary, address existing gender imbalances, or support the career advancement of women within the judiciary.
- Gender sensitivity and awareness: Anecdotal evidence suggests that JoZ lacks gender sensitivity and awareness among the judicial and non-judicial workforce in servicing women, particularly in cases related to gender-based violence (GBV), where understanding and sensitivity are crucial. Training and capacity-building programs on gender sensitivity are either inadequate or nonexistent, which perpetuates gender biases within the judiciary system.
- External Aspects:
- Access to judicial services: Women, children, people with disabilities, and survivors of GBV face significant barriers to accessing judicial services, in 2023 for example, only 17 percent of court users were female. These barriers include gender-biased social norms and cultural pressure, low levels of knowledge concerning their rights, and standard court operating procedures and protocol. This puts sustainable progress toward fairness, equality, and legitimacy, reducing barriers to access to justice and bringing women’s voices and perspectives and those of other marginalized groups to the justice process at risk.[2]
