REQUEST FOR EXPRESSION OF INTEREST (EOI) FOR AN INDIVIDUAL CONSULTANT TO DEVELOP SOUTH SUDAN ANTI-CORRUPTION REGULATIONS AND OPERATIONAL PROCEDURES

  • Background

The Government of the Republic of South Sudan, through the Ministry of Finance and Planning (MoFP) has received grants from the World Bank (WB) towards the cost of implementing various Public Financial Management reforms under the Public Financial Management and Institutional Strengthening (PFMIS) Project. The project aims to advance critical PFM reforms that will lay a strong foundation for more advanced reforms, strengthen key oversight institutions, and improve budget transparency and overall PFM outcomes in the country.

One of the key project interventions is to develop comprehensive regulations and associated operational procedures to facilitate the implementation of the amended South Sudan Anti-Corruption Act of 2009 (amended 2023).

The assignment envisages defining principles and providing detailed guidelines and procedures for the prevention, investigation, and prosecution of corrupt practices, as well as mechanisms for promoting transparency, accountability, and public participation in anti-corruption efforts.

It is against this background that the Ministry of Finance and Planning intends to engage an Individual Consultant to develop Anti-Corruption Regulations and Procedures and provide necessary training for the South Sudan Anticorruption Commission.

  • Scope of Work and Responsibilities:

The Consultant will provide technical guidance and hands-on support to the South Sudan Anti-Corruption Commission to strengthen its capacity by interacting and consulting all the Anti-Corruption institutions in the country including those operating in the 10 States and the 3 Administrative Areas. The regulations must indicate, with reasonable certainty to those who are bound by the Act, what is required of them so that they may adjust their conduct accordingly.

The Consultant will be required to undertake all tasks and deliver the outputs detailed in the Terms of Reference (TOR) that will be provided upon request through the email contact below.

  • Selection Criteria:

Selection shall be based on the qualifications and experience of the candidate and followed by an interview. The qualifications and experience required for shortlisting include:

  • Advanced degree in law, public administration, public policy, or a related field.
  • Proven experience of at least 10 years in legal drafting, particularly in the development of legislation and regulations related to anti-corruption.
  • At least 7 years of experience in developing facilitating and supporting anti-corruption reform efforts, governance, or related fields, with specific experience in drafting policies, laws, and regulations.
  • In-depth knowledge of anti-corruption laws, international frameworks, standards, and best practices related to anti-corruption at both regional and international levels.
  • Demonstrable experience of at least 5 years in providing training as a mechanism for disseminating national legal and regulatory frameworks and facilitating their implementation.
  • Strong analytical and research skills, with the ability to interpret complex legal documents and regulations.
  • Excellent communication and consultation skills, with experience in engaging diverse stakeholders.

The shortlisted candidates will be invited for an interview. The Consultant will be required to possess the experience, skills, and competencies listed in the TOR.

Government officials or civil servants will not be considered unless: (i) they are on leave of absence without pay or have resigned or retired six months before the date of the advert, and (ii) their employment will not create a Conflict of interest.

  • Duty Station and Duration:

The position is based in Juba, South Sudan and the assignment will be carried out over a period of 65 days

  • The attention of interested individual consultants is drawn to Section III, paragraphs 3.14, 3.16, and 3.17 of the World Bank’s ‘Procurement Regulations for IPF Borrowers’ July 2016 revised November 2017, July 2018 and November 2020 [Procurement in Investment Project Financing; Goods, Works, Non-Consulting and Consulting Services], setting forth the World Bank’s policy on conflict of interest
  • A Consultant will be selected per the Individual consultant selection method set out in the World Bank’s Procurement Regulations.
  • The Ministry of Finance and Planning now invites eligible Individual Consultants to indicate their interest in providing the above-mentioned services. Interested consultants must provide information indicating that they are qualified to perform the services and furnish the Curriculum Vitae (CV) in the prescribed form that will be provided with the TOR upon request through the e-mail given below.
