Assignment Title: Review of the Information and Communication Amendment Act 2014

The Government of The Gambia has received financing from the World Bank toward the cost of the Gambia Fiscal Management Project, the Directorate of Public Private Partnership Enterprise (DPPPE) anchored within the Ministry of Finance & Economic Affairs (MoFEA) is the lead Implementing Agency of the Project, and intends to apply part of the proceeds for consulting services.
The consulting services (“the Services”) include advise and assist Government of The Gambia in the successful formulation and implementation of the country’s new information and Communication legislation and regulations. It is divided into three phases, of which the second phase is subdivided into two parallel tracks, phase 2a and phase 2b, as follows:
Phase 1: Review of the legal and regulatory framework and drafting of the new sector law.
Phase 2a: Amendments to the regulatory framework.
Phase 2b: Institutional diagnosis and PURA strengthening plan.
The detailed Terms of Reference (TOR) for the assignment are attached to this request for expression of interest.
The Ministry of Finance & Economic Affairs now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.
The shortlisting criteria are: The consultant is expected to be a firm or a joint venture of firms.
Qualifications and Experience
- The firm or joint venture should be an established ICT and Telecom related consulting firm/firms dealing with legal, regulatory, management and restructuring.
- the firm or joint venture should have sufficient experience in sub Saharan Africa ICT and telecom legal, regulatory and policy.
- Experience in formulation of Telecommunications (including broadcasting) law, policy and regulations.
- Experience in sub Saharan Africa ICT and telecom legal, regulatory and policy.
- Have at least 2 assignments in reviewing Telecoms/ICT laws and regulations.
- Experience in Drafting of ICT related Bills in similar jurisdictions.
- Reviewing and drafting media related provisions
- Experience in liberalization, commercialization, privatization and restructuring of telecommunication industry
- Familiar with international practices in telecommunications/ICT policies, laws and strategies formulation and familiar with the overall value chain of ICTs; from infrastructure to networks, application and services.
- Provide audited accounts up to 5 years.
The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” July 2016 and revised November 2017 and August 2018 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest. In addition, please refer to the following specific information on conflict of interest related to this assignment: on conflict of interest related to the assignment as per paragraph 3.16 and 3.17 of the Procurement Regulations.
Consultants may associate with other firms to enhance their qualifications but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.
A Consultant will be selected in accordance with the Quality and Cost-Based Selection method set out in the Procurement Regulations.
Language of Assignment: The language of communication and writing reports is English
The duration of the assignment is 6 months.
