Assignment Title: Hiring of a Consultant for the Development of e-GP Regulations for the Gambia Public Procurement Authority

- Context and Background information on the Consultancy
The Gambia Public Procurement Authority (GPPA) is the government regulatory body charged with the regulatory functions of the national public procurement system and has the responsibility of developing the country’s e-procurement system. Its Director General is appointed by the President of the Republic.
The Public Procurement Act 2022 includes provisions for the development of an e-procurement system by the Gambia Public Procurement Authority to create an effective and secure e-procurement system, create standard bidding documents for public procurement and other activities aimed to gradually put the current country procurement system in line with the requirements of best practices in e-procurement. The e-procurement system will be helpful to the public contracting authorities, to purchase goods and services faster and efficiently and increase efficiency and effectiveness of public procurement in general.
The GPP Act of 2022 provides for the use of the electronic procurement (e-GP) system in public procurement in the Gambia as the process of procurement using the internet or other information and communication technologies, however, it does not go into details on the modalities of using the e-GP system. With the implementation of the e-GP system, there is need for regulations to establish detailed legislation to govern the use of the e-GP system.
A FIRM is hereby required to carry out the assignment of developing an e-Government Procurement Regulations benchmarking on the e-GP system requirements and in collaboration with The Gambia Public Procurement Authority which is the e-GP implementing agency.
- Objectives and SCOPE OF THE ASSIGNMENT
- Objectives:
The objective of this assignment is to develop an e-GP Regulations which will guide the implementation and governance of an electronic government procurement system in The Gambia in accordance with the GPP Act 2022 and Regulation 2023.
- Scope of Service:
The consultant will draft e-GP Regulations for the use of ICT in Public Procurement for GPPA. The Regulations will reflect international good practice and will be cognizant of the socio-economic and operating conditions in the Gambia including but not limited to the digital landscape in the Gambia. The e-GP regulations will also take into account the existence and compliance with the Electronic Communications Bill of 2022.

Contract Duration: 90 days
- Composition and qualification of the key team and selection criteria
Composition and Qualification of The Key Team.
The successful Consultant, a firm or an association of firms, shall propose a team comprising a team leader and a number of experts in various relevant specializations. As a matter of requirement, the firm should demonstrate in their proposed team the following skills and expertise:
- Legal expertise in Public Procurement and ICT Law: The team should possess extensive knowledge of the legal frameworks surrounding public procurement, electronic and cyber laws especially experience in legal analysis, drafting regulations, and ensuring compliance with existing laws.
- International e-Government Procurement expertise: An individual with a deep understanding of international best practices in e-Government procurement. This should include experience with e-GP implementation and legislation, regulations, guidelines, and directives from African countries. A proven track record of implementing e-Government procurement systems in varying socio-economic conditions is paramount.
- The firm shall also demonstrate the following skills: expertise working with standard bidding documents and regulatory drafting.
Submission of Expressions of Interest:
The Ministry of Finance and Economic Affairs (MoFEA) through the Gambia Resilience, Inclusion, Skills and Equity Project, now invites eligible consulting firms to indicate their interest in providing the Services. Interested Consulting firms should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.
The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” dated September 2023 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest. Consultant Firms may associate with other firms in the form of a joint venture or a sub consultancy to enhance their qualifications.
A Consultant will be selected in accordance with the Consultant Qualification Selection Method (CQS) method set out in the Consultant Guidelines. Further information can be obtained at the address below during office hours from 09:00 to 16:00 Monday to Thursday and 09:00 to 12h30 on Friday.
