Ref No.SO-MOF-473719-CS-CQS1. Background: The Republic of Somalia has received financing from the World Bank towards the cost of the Somalia Capacity Advancement, Livelihood and Entrepreneurship, through Digital Uplift Program (SCALED-UP) project; and intends to apply part of the proceeds of the above project to finance the Consultancy Services to provide technical advisory services on the development of key policy, operational, and internal governance frameworks to enable the DPA to effectively implement and enforce compliance with the DPL, in line with its mandate. .2. Responsibilities: The consulting firm will develop and draft DPA policies and procedures aligned with national and international data protection regulations. This includes internal regulations, data handling policies (e.g., privacy notice, cookie policy, staff training), and guidelines on key data protection topics such as registration, breach notification, and international data transfers. The consulting firm will also create necessary forms, templates, and reporting tools and support the establishment of monitoring and enforcement frameworks, including compliance monitoring, complaint handling, sensitive data regulations, and an international data transfer adequacy framework. Duration: The firm is expected to complete the proposed assignment within 5 Months.4. The Ministry of Finance now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services (brochures, description of similar assignments, experience in similar conditions, availability of appropriate skills among staff etc.). The shortlisting criteria are as follows:• Core business of the firm; A law firm/ a consulting firm with a minimum of 6 years expertise in the data protection field or a consortium of such firms consisting of lawyers and other qualified professionals with high international repute and relevant experience in the legal, regulatory, institutional, and technical aspects• Specific experience in successfully implementing similar assignments. (The firm must have proven experience in successfully implementing similar assignments, demonstrating familiarity with international data protection and privacy laws, standards, and best practices.). (The Consultant shall provide the name and contact address of the Client (office and e-mail address and telephone number), date(s) of execution, name (s) of lead and associate firms, contract amount and financing sources.• Experience of relevant services in an environment similar to that of Somalia and• Technical and managerial organization of the firm (provide only the structure of the organization). Do not provide CVs of key staff. Key experts will not be evaluated at the shortlisting stage.5. Attention of interested Consultants is drawn to section III, para 3.14,3.16 & 3.17 of the World Bank’s Procurement Regulations for IPF Borrowers: Procurement in Investment Projects Financing Goods, Works, Non -Consulting and Consulting Services dated in September 2023 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.6. Consultants may associate with other firms to enhance their qualification but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected7. A Consultant will be selected in accordance with the Consultant Qualification Selection (CQS) method set out in the Procurement Regulations.8.
