Title of Assignment: TA for Pharmacy Bill Regulations

  • Background of the Project The Government of the Kingdom of Eswatini through the Ministry of Health (MOH) entered into a loan agreement with the World Bank effective on 10 December, 2020, to implement a Health System Strengthening for Human Capital Development Project in Eswatini (HSSHCDP). The project focuses on strengthening the health system and ramping up investments in reproductive, maternal, new-born, child and adolescent health (RMNCAH), nutrition, and non-communicable disease (NCD) services to address critical human capital challenges, including stunting and child and adult mortality, applying a life course approach. The project has four components namely; Component 1: Improve health service delivery to increase the coverage and quality of health services to build human capital; Component 2. Increase community demand for RMNCAH, nutrition and NCD services; Component 3. Strengthen the MOH’s stewardship capacity to manage essential health and nutrition services and project activities and Component 4: Contingent Emergency Response.
  • Background to the assignment

The Government of the Kingdom of Eswatini through the MOH embarked on an exercise to address the shortcomings of the Public Health Act of 1969, through the Health Act of 2023. The Public Health Act of 1969 was strictly limited to issues of public health. The new Heath Act 2023 over and above the protection of public health seeks to now strengthen the health capacity system and its performance for effective health service delivery and for incidental matters.

  • Objective of the Assignment

The MOH, with support from the HSS4HCDP, intends to draft and finalize the Health Regulations. The Health Regulations will give effect to the implementation of the provisions of the Health Act 2023 and these Regulations will be applied to strengthen the health capacity system including the MOH’s stewardship capacity to manage and regulate health service delivery, improve its performance for effective health service delivery, and protect public health; and ultimately strengthen the Ministry of Health stewardship capacity to manage and regulate health services delivery..

The MoH seeks to engage the services of the Consultant to render Technical Support Services necessary for the drafting of the Health Act Regulations including submission and approval of the Regulations.

A detailed description of the required Services is given below in these Terms of Reference (ToR):

  • General scope of work

The Consultant shall perform all work necessary as called for in the TOR including all technical studies and related services. In carrying out their work, the Consultant shall cooperate fully with the concerned agencies of the Government of Eswatini, in particular the Project Coordinator, Director of Health Services, Planning Unit in the MOH, among others. The Consultant shall provide the support services related to and necessary for the completion of the assignment. The work shall cover but not be limited to the aspects outlined in the TOR.

  • Duties and Responsibilities
  • Develop an Inception Report outlining an initial assessment of the tasks and proposed methodology and work plan.
  • Review and consider the context of the regulation of the health capacity system and its performance for effective health service delivery and the protection of public health in Eswatini;
  • Review and consider Health Regulatory Framework for applicable standards and framework;
  • Review and consider stakeholder perceptions on the regulation of the health capacity system and its performance for effective health service delivery and the protection of public health in Eswatini.
  • Review and consider the relevant risks, opportunities, weaknesses and strengths.
  • Identify areas of improvement under the regulations with the Directorate Department;
  • Revise and improve Health regulations as per national requirements (Attorney General’s Office);
  • Present the revised regulations to MoH and stakeholders for comments and approval; and address stakeholders’ comments in close consultation with the MOH and the Attorney General’s Office.
  • Qualification and Experience

The consultant should have the following qualifications, experience and competencies:

  • LLB in Law and at least 10 years of experience in policy and regulation drafting.
  • Proven experience in drafting Health or relevant policy and regulations.
  • In depth knowledge of health service management preferably in Eswatini or SADC.
  • An ability to work closely with stakeholders at all levels relevant to the work being undertaken.
  • Understanding of government and the political economy of decision making including good knowledge of the Government policies and drafting of regulations (i.e. systems, protocols, procedures etc.).
  • Proficient communication and writing skills with a good ability to translate complex technical information across various audiences.
  • Fluent in spoken and written English.
  • Understanding of Siswati will be an added advantage.
  • Resources to be Provided by the Client

The Consultant will be provided with the following resources:

  • Venue, refreshments and conferencing accessories during presentations and validation sessions. Any additional resources needed shall be borne by the Consultant.
  • Duration of Service

The period for the assignment is sixty (40) working days over a period of nine months.

  • Reporting Arrangement:

The Consultant will report to the Director of Health Services of the Ministry of Health and Project Coordinator.

  • Duty Station Mbabane, with field visits as required.
  • Remuneration and payment schedule In accordance with relevant Kingdom of Eswatini guidelines as applicable.
