Government of Lesotho LESOTHO COMPETITIVENESS And Financial Inclusion project REQUEST FOR EXPRESSIONS OF INTEREST RE-ADVERTISEMENT CONSULTING SERVICES - INDIVIDUAL CONSULTANT (IC) SELECTION Country : Lesotho Project Name : Competitiveness and Financial Inclusion Credit No. : P175783- LSO Assignment Title : Legal Consultant- Strengthening the Credit Infrastructure system Reference No. : LS-MTI-367031-CS-INDV The Government of Lesotho has received a loan from the International Development Association (IDA) of the World Bank to implement the Lesotho Competitiveness and Financial Inclusion (CAFI) Project and intends to apply part of the proceeds for consulting services.
One of the key Individual Consulting Services positions within the CAFI Project is that of the Legal Consultant for Strengthening the Credit Infrastructure System. The Consulting Services to be provided by the Financial Sector Specialist include, inter alia: undertake review and gap analysis of the existing credit reporting Law to identify possible gaps and alignment with international best practice; identify and consult with all stakeholders to inform the review and gap analysis; prepare draft policy for workshopping and presentation to the Client and Stakeholders; prepare legal provisions for improvement of the credit reporting law to allow provision of corporates’ credit information and other necessary requirements; identify relevant/additional data to be included in the credit bureau to enhance the use of the credit reporting system; identify regulatory powers and other legal instruments for the regulator to properly supervise the credit market from other areas including the non-financial institutions; lead presentation in the presentation and workshopping of the draft policy and draft amendments or bill; and draw a detailed project plan with a clear sequence of tasks to be implemented in carrying out the above-mentioned objectives.

The Ministry of Trade, Industry, Business Development and Tourism through the PMU, now invites eligible Individual Consultants to indicate their interest in providing the above-mentioned Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.
The selection criteria include: A minimum of Master’s Degree in Law, with specialty in corporate law or similar; at least 7 years’ experience in development of Financial Laws (Development of the Credit law will be an added advantage); expertise in drafting policies, development of credit information laws, supervision methodologies and manuals; expertise in drafting policies and the development of financial sector reforms and familiarity with the Laws and the Legal Drafting System in Lesotho. Interested candidates are required to submit their Curriculum Vitae (C.V) together with educational certificates and Expression of Interest (EOI) to the address below.
The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” November 2020 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest. The Legal Consultant will be selected in accordance with the Individual Consultant Selection method set out in Procurement Regulations.
