GOVERNANCE AND DIGITAL ECONOMY OF SÃO TOMÉ AND PRINCÍPE: LEGAL FRAMEWORK ENABLING CIVIL REGISTRATION, DIGITAL IDENTITY AND DIGITAL ECONOMY

Assignment Title: Technical Assistance for the development of a legal framework that allows civil registration, digital identity and digital economy in S. Tomé and Príncipe

The Government of São Tomé and Príncipe (GoSTP) has received a grant from the International Development Association (IDA) to cover the cost of the DIGITAL SÃO TOMÉ E PRÍNCIPE PROJECT (DSTP) and intends to apply part of the proceeds for consulting services.

The consulting services (“the Services”) include to SUPPORT THE GOVERNMENT TO DEVELOP A LEGAL FRAMEWORK ENABLING CIVIL REGISTRATION, DIGITAL IDENTITY AND DIGITAL ECONOMY.

It is intended to hire a consultancy company to draft new legal acts (codes, laws, decrees, regulations, etc.) on digital identity, electronic government, data protection, access to public information, cyber security, cyber crime, electronic commerce and others, if relevant, to GoSTP. The task to be performed by the Winning company is to draft the relevant legislation and facilitate legal workshops with national stakeholders.

The Terms of Reference (TOR) for the assignment can be obtained at the address given below.

The DSTP now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are:

• Experience in consultancy in the areas of digital economy (digital identification, data protection, cybersecurity, digital transactions and others) relevant to the work in these ToRs.

• Experience in consultative processes, stakeholder engagement in legal review processes, production of laws, advising governments on the adoption of laws, made by the company or as a subcontractor or joint venture partner, in São Tomé and Príncipe or similar countries.

• Experience in creating and adopting Laws related to the areas listed in this ToR (digital economy, identity, digital transactions, and others), and in São Tomé and Príncipe or experience in similar countries.

Key Experts will not be evaluated at the shortlisting stage. The shortlist will contain 5 to 8 firms.

The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” dated September 2023 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.

Consultants may associate with other firms to enhance their qualifications, but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.

A Consultant will be selected in accordance with the QCBS – Quality Cost Based Selection method set out in the Procurement Regulations.
